John A. Gustafson, Plaintiff in Error, vs. The State of Oklahoma, Defendant in Error. No. _____
MOTION TO RECONSIDER STIPULATION TO ADVANCE.
Comes now that plaintiff in error, and moves the Court to reconsider the Stipulation to Advance the above entitled cause, and in support of said motion, states: (1) Said plaintiff in error was convicted of gross neglect of duty in office in connection with the recent race riot in Tulsa, and for conspiracy to aid automobile thieves. There was no evidence to warrant a conviction of gross neglect of duty on either count, and the said plaintiff in error did not have a fair trial in the court below. (2) The said plaintiff in error was Chief of Police of the City of Tulsa, and the term of office to which he was appointed will expire in May next, and unless this cause is advanced, the appeal will avail him nothing, and the City of Tulsa will be without his services for the remainder of his term of office, to which it is entitled if his conviction was wrongfully obtained. (3) The public are interested in the advancement of this cause, as well as the plaintiff in error, and for that reason the same should be advanced.
