This office has received your request for an official Attorney General Opinion in which you ask, in
effect, the following questions:
1. May the board of county commissioners purchase land for holding a
county free fair without using bond monies?
2. Maya Free Fair Board transfer some of its funds on hand to its board
of county commissioners to enable the board of county commissioners to
purchase land for free fair use?
You state that a county has been leasing facilities in which to hold county fair meetings from a city.
You also state that the county's Free Fair Board has accumulated sufficient money in its accounts
to fund the purchase of land upon which to conduct free fair meetings without borrowing funds for
such a purpose. I Your questions involves resolution of two basic legal questions: (1) whether a
board of county commissioners of a county has legal authority to purchase land for county free fair
purposes, and (2) whether such property may be purchased with funds accumulated by a Free Fair
Board without undertaking a bond issue for such purposes.
