Robinson Ave., Suite 600 Oklahoma City, Oklahoma 73102 Dear Ms. Snodgrass: October 1,2013 This office has received your request for an official Attorney General Opinion in which you ask, in effect, the following questions: 1. May the Oklahoma Tourism and Recreation Department, pursuant to the authority granted under 74 O.S.2011, § 2232 and consistent with constitutional limitations on the use of public funds, enter into an agreement with a private entity to administer the annual Governor's Conference on Tourism and, if so, must the selection of such entity comply with the bidding procedures set forth in the Oklahoma Central Purchasing Act, 74 O.S.2011 & Supp.2013, §§ 85.1 - 85.5? 2. Does 74 O.S.2011, § 2232 require the Oklahoma Tourism and Recreation Department to create a special agency account in connection with the Governor's Conference on Tourism and deposit all proceeds from the conference into that account? INTRODUCTION The Oklahoma Tourism and Recreation Department The Oklahoma Tourism and Recreation Department ("Tourism Department" or "Department") was created in 1972 pursuant to the Oklahoma Tourism and Recreation Act as the successor agency to the Oklahoma Industrial Development and Park Department. See 1972 Okla. Sess. Laws ch. 152, § 2. While that statute was repealed1 and largely replaced in 2005 by the Oklahoma Tourism, Parks and Recreation Enhancement Act, the Tourism Department remained and its statutory purposes were 1 2005 Okla.
