The subject property is situated next to the American Legion Park in Seminole. The purpose of the TBA was to identify potential environmental concerns by reviewing historical data, regulatory information, and by performing a visual inspection of the site and surrounding area. The following is an executive summary of the environmental site assessment results: • Historic recognized environmental conditions (REC) include the old, abandoned, potentially unplugged oil wells. • The former Seminole Armory was built in 1953. The land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard. The subject property is currently owned by the State of Oklahoma. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A MOA will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse by the DEQ. • The building is probably contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program plans to cleanup any lead and asbestos contamination on the subject property and properly dispose of all associated waste. The possible lead and asbestos contamination in the building may constitute a recognized environmental condition (REC). • The property formerly contained a 1,000 gallon underground storage tank (UST) that was removed August 29, 1997. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380mg/k and 20 mg/kg, respectively. The former UST and associated contamination constitutes a historically recognized environmental condition (HREC). • Adjoining properties consist of baseball fields and undeveloped land. Historical aerial photographs show parks surrounding the subject property. ��� Sanborn Fire Insurance maps showed that the subject property was vacant land before the armory was built. A lake surrounded the vacant land between 1933 and 1949. Adjacent properties consisted of undeveloped areas and a commercial sector. Sanborn maps revealed that a National Guard Armory occupied a small office space on E Broadway Street near the intersection of Main Street. This property is separate from the property being investigated in this Targeted Brownfield Assessment. • No National Priority List (NPL), delisted NPL sites, Resource Conservation and Recovery Act (RCRA) non-corrective action sites (CORRACTS) treatment, storage, and Phase I TBA Seminole Armory Seminole, Oklahoma 7 disposal (TSD) listings, Emergency Response Notification System (ERNS) list, Institutional Controls/Engineering Controls, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM recommended search radii. No RCRA generators, Voluntary Cleanup (VCP) sites, or Brownfield sites were found on the subject property. The subject property is on the DEQ Site Cleanup Assistance Program (SCAP) list for cleanup of lead and asbestos contamination. There were seven RCRA generators listed within one mile of the subject property, and two active or archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) site listings. • Thirty-one underground storage tank sites were found within a ½ mile radius of the subject property. The UST sites are located east, west, southwest, and northwest of the subject property. The closest USTs to the subject property are located within one or two blocks from the subject property and are listed as permanently out of use. It is unknown if those tanks have been removed. Of the thirty-one USTs, four sites have current and historic leaking underground storage tank cases. • Oil and gas development was found in the OCC oil and gas records for the quarter, quarter, quarter sections directly above and upgradient of the site. • Pole mounted transformers, in good condition without any leaks, are located around the armory building. It is unknown if these transformers contain PCBs. Fluorescent lighting ballasts are located throughout the building. The lighting ballasts are all in good condition. It is unknown if the lighting ballasts contain PCBs. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous. 2.0 INTRODUCTION The State of Oklahoma Department of Environmental Quality (DEQ) under a Brownfield Assistance Agreement (No. RP96681001-0) (Ref. 1) with the U.S. Environmental Protection Agency (EPA) conducted a Targeted Brownfield Assessment of a property located 600 E Strothers Ave, Seminole, Oklahoma. 2.1 Purpose The purpose of this assessment is to look at the environmental conditions within the target area and provide this information to the American Legion as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfield’s Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3). The purpose of a Phase I Environmental Site Assessment is to identify, to the extent feasible, recognized environmental conditions in connection with the target property through a systematic review of readily available information sources and a site reconnaissance. Phase I TBA Seminole Armory Seminole, Oklahoma 8 DEQ is providing technical assistance to the project by evaluating the environmental condition of the property prior to the American Legion owning the property. Funding for this assessment has been provided by the U.S. Environmental Protection Agency (EPA). 2.2 Detailed Scope-of-Services DEQ examined the current use of the property and then identified the historical uses of the property to determine if recognized environmental conditions exist. DEQ examined historical documents, governmental databases, oil and gas records, aerial photographs, Sanborn Fire Insurance Maps, and conducted interviews and a site reconnaissance of the area. A good faith effort was made to identify possible environmental conditions that might affect the development of the property. 2.3 Significant Assumptions History and knowledge of the subject property shows that the building was used as a National Guard Armory. Prior to armory construction in 1953, the property was vacant land owned by the neighboring American Legion. There has been no oil and gas exploration on the property according to Oklahoma Corporation Commission records. Since the building was constructed in 1953, the building is likely to contain asbestos containing materials (ACM). The U.S. began banning the use of asbestos in most building materials in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. Pipe wrap and suspect floor tile were observed in the building during the site reconnaissance conducted on September 9, 2010. It is also likely that the building contains lead-based paint. The DEQ plans to have a lead-based paint, lead dust and asbestos survey conducted on the property. 2.4 Limitations and Exceptions The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability, land use restrictions, or cause delays in revitalization. The ASTM Phase I Environmental Site Assessment E 1527 – 05 (Ref. 4) is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the revitalization project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. This assessment was conducted under constraints of time, cost, and scope and reflects a limited investigation and evaluation. It reflects the normal degree of care and skill that is ordinarily exercised by environmental professionals conducting business in this or similar localities. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost or Phase I TBA Seminole Armory Seminole, Oklahoma 9 expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law. The information in this report is based on a review of governmental records, interviews with knowledgeable representatives of the property, information provided by the City of Seminole, and observations of the environmental professional. The result of this assessment, as written in this report, is valid as of the date of report. The assessment does not include sampling of rock, soil, groundwater, surface water, or air. For qualifications of environmental professionals see Appendix I. 2.5 Special Terms and Conditions This assessment report has been prepared for the American Legion by the DEQ using EPA funding. Information about this report will be provided to the EPA for its files. This report and the working file are public record and subject to the Oklahoma Open Records Act and the federal Freedom of Information Act. 3.0 SITE CHARACTERIZATION AND HISTORY 3.3 Location and Legal Description The subject property is located in the east quadrant of E Strother Avenue and N Main Street in Seminole, Oklahoma. This property consists of approximately 1.68 acres of land and contains the former National Guard Armory building. A site map and topographical map depicting the property have been provided in Appendix A. The subject property is located in the Northwest Quarter (NW/4) of the Northwest Quarter (NW/4) of Section 27, Township 9N, and Range 6E. The armory building’s legal location is described as 1796 ft East and 33 ft South of NW corner and 225 ft South, 325 ft East, 225 ft North and 325 ft West to the point of beginning of original plat to the City of Seminole, Seminole County, State of Oklahoma. Records at the Seminole County Courthouse were searched to determine ownership and operational history of the subject property. It was determined that the property was previously owned by the American Legion and deeded to the State of Oklahoma for the purpose of building a Oklahoma National Guard armory in 1953. Prior to 1953 the property was privately owned by several individuals. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A Memorandum of Agreement (MOA) will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse. Seminole County Courthouse Records showed the following history on the property. See Appendix C for copies of these documents. All documents reviewed at the county courthouse are located in Appendix J. Phase I TBA Seminole Armory Seminole, Oklahoma 10 • On July 1, 1912 the NW quarter of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to Maria Jackson by Principal Chief of Seminole Nation. Warranty Deed (WD). • On July 9, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to W.H. Lenfesty by Maria Jackson. WD • On August 02, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to W.H. Lenfesty by Maria Jackson. WD • On September 02, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to Maria Jackson by W.H. Lenfesty. Quick Claim Deed (QCD). • On December 18, 1915 the NW quarter of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to G.E. Presley by James Carter guardian of Maria Jackson a minor. • On February 1, 1916 the NW quarter of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9, and range 6E containing 80 acres also lot 1 to 14 inclusive in block 1 and lots 1 to 4 inclusive in block 4 to Batey Addition to Incorporated town, also beginning at the northeast corner of lot 1 block 1 to said Batey Addition above named running thence east 767 feet, thence south 685 feet thence west 767 feet to northeast corner of lot 13 in block 4 Batey Addition above described thence north 685 feet to point of beginning all being in the NW quarter of the NW quarter of Section 27, Twp. 9N, Range 6E containing 95 acres were sold to W. A. Bishop by G.E. Presley and Amy Presley. WD • On November 27, 1918 the NE quarter of the NW quarter and the NW quarter of the NE quarter of Section 27, Township 9, and range 6E were sold to W. B. Gray by W.A. Bishop and Almedia Bishop. WD • On November 19, 1919 the NE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to W. C. Reed by W. B. Gray and Cora Gray. WD • On October 8, 1924 the NE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to Herman A. Bishop by William C. Reed and Willie Reed. Gray and Cora Gray. QCD • On January 14, 1925 the NE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to Homer H. Bishop by Herman A. Bishop and Opal Bishop. QCD • On February 6, 1925 the NE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to W. A. Bishop by H.H. Bishop and Louis Slover Bishop. QCD • On February 27, 1925 the NE quarter of the NW quarter and the North half of the SE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to J.G. Berry by the Oklahoma State Bank of Konawa. QCD • On December 28, 1928 the NE quarter of the NW quarter of Section 27, Township 9, range 6E and the SW quarter of the SW quarter of section 22, Township 9N, Range 6E minus 8 acres in the SW corner of the above described tract of land were sold to W.A. Bishop by the Homer H. Bishop. QCD • On April 15, 1930 the NW quarter of the NE and the NE quarter of the NW quarter and lots 1 to 28 inclusive in Block 1, Bishop Addition to the City of Seminole, Oklahoma, and a tract of land beginning at the NE corner of Lot 1, Block 1, Bishop Addition above named, running thence due South to the North side of Walnut Street, thence West to the West Bank of the present creek channel where Walnut Street and the present creek intersect, thence along the West bank of the present creek channel to the SE corner of the NW corner of the NW quarter, thence due North to the NW corner of the NE quarter of the NW quarter, thence due west to point of beginning, containing approximately 95 acres, more or less, and the following described land. Phase I TBA Seminole Armory Seminole, Oklahoma 12 • On October 12, 1953 beginning at a point 1796 ft East and 33 ft South of NW corner and 225 ft South, 325 ft East, 225 ft North and 325 ft West to the point of beginning were sold to State of Oklahoma for benefit and use of the Oklahoma National Guard 3.4 Site and Vicinity Characterization The former Seminole Armory was built in 1953. According to Seminole County land records, the land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard (see Appendix C). The subject property is a small tract of land about one acre and a half in size. The subject property is located at 600 E Strothers Ave, Seminole, Oklahoma bound by E Strothers Ave on the north, Armory Drive on the West and E Seminole Ave on the south. The areas where the subject property and adjacent properties are located are best characterized by recreational development and undeveloped land. Undeveloped land surrounds the property to the north and east and the American Legion Park resides to the west and south of the property. A site vicinity map of the subject property can be found in Appendix A and C. Lead-based paint and asbestos may be present onsite due to the age of the building. Utilities that serve the subject property are CenterPoint Energy for natural gas and the OG&E electric, AT&T provides telephone services, and the City of Seminole provides sewer services to the armory according to Buster Wilcox, facility occupant for the American Legion (Ref.5). According to the Oklahoma Water Resources Board Water Information Mapping System, the subject property is served by the City of Seminole. A review of the topographical map indicated that the surface elevation of the site is approximately 850 feet above mean sea level. The topographical gradient is to the southeast, toward Magnolia Creek. The Magnolia Creek is located approximately 0.2 miles east of the site. Wewoka Creek is located 0.7 miles south of the subject property. The Magnolia Lake used to surround the property during 1933-1949. However, the subject property was never flooded. Magnolia Lake is reduced in size and resembles a pond and is located to the southwest of the property. The topographical map can be found in Appendix A. 3.5 Description of Structures, Roads, and Other Improvements The structure of the Armory is in good condition. The roof of the Drill Floor is in excellent condition. According to Buster Wilcox, the Drill Floor roof was replaced. There was only one observed damaged window at the Armory. Roads surrounding the Armory are in good condition. All roads are constructed of asphalt pavement. Adjacent properties, which consist of a park and undeveloped land, are in good condition. Throughout the facility, there are floor drains. Based on previous armories, it is thought that these drains lead into the city sanitary sewage pipes, but at the time of this report that could not be confirmed. Phase I TBA Seminole Armory Seminole, Oklahoma 13 3.6 Owner, Property Manager, and Occupant Information The subject property is owned by the State of Oklahoma and is occupied by the American Legion. The DEQ Site Cleanup Assistance Program (SCAP) is in charge of identifying environmental hazards and conducting the cleanup of the Armory. The Military department will transfer ownership of the armory to the American Legion prior to completion of remedial activities. 3.7 Information Reported by User Regarding Environmental Lien or Specialized Knowledge or Experience The property owner and/or representatives reported no environmental liens on the subject property, and had no specialized knowledge or experience regarding recognized environmental conditions. The DEQ conducted a search for environmental liens at the Seminole County Courthouse. No environmental liens or use limitations were reported for the subject property. 3.8 Commonly Known or Reasonably Ascertainable Information Buster Wilcox, representative of the American Legion, had no exceptional knowledge of commonly known or reasonably ascertainable information within the local community about possible environmental conditions on the property. It is known within the community that the building functioned as a National Guard Armory. 3.9 Valuation Reduction for Environmental Issues Valuation of the property is outside the scope of this assessment. A professional appraiser should be consulted to place a value on the property. 3.10 Current Use of the Property The buildings are currently being used as storage by the American Legion and Emergency Management Services (EMS). The office located in the north of the property is currently used by the EMS as an office. A trailer with a boat is stored inside the west building. The rest of the property is vacant land. 3.11 Past Use of the Property 3.9.1 Review of Aerial Photographs Historic aerial photographs were searched to view the changes to the property over time. Aerial photographs were obtained from the Department of Libraries and the DEQ database of archived and present-day photographs. Aerial photographs from 1938, 1956, 1995, 2003, and 2008 were obtained. All these photographs are located in Appendix B. The following represents a summary of what was found at the subject property from each photograph. Phase I TBA Seminole Armory Seminole, Oklahoma 14 1938 aerial photograph The 1938 aerial photograph shows the subject property to be near an area of oil and gas production. Five tanks were located southeast of the subject property. The adjoining property to the north was undeveloped. Sanborn maps show the surrounding area to the subject property was developed as the Magnolia Lake. However, the subject property area was not flooded. Commercial buildings were located west of the property. 1956 aerial photograph The 1956 aerial photograph shows the subject property with two distinct buildings. The tanks that were present on the southeast area of the subject property were removed by 1956. The adjoining property to the north was undeveloped. The areas to the west and south were developed as commercial and residential areas. 1995 aerial photograph The 1995 aerial photograph shows some changes from the 1956 aerial photograph. There is some residential and commercial development to the east of the subject property. It was also noted a park development north to the subject property. No apparent environmental conditions were noted from the photograph. 2003 aerial photograph The 2003 aerial photograph shows some changes from the 1995 aerial photograph. The photograph shows commercial development to the northeast of the subject property. No apparent environmental conditions were noted from the photograph. 2008 aerial photograph The 2008 aerial photograph shows some changes from the 2003 aerial photograph. The west and south areas adjacent to the subject property were developed as baseball fields. The remaining areas were unchanged from the 2003 aerial photograph. 3.9.2 Fire Insurance Maps Sanborn Fire Insurance maps were viewed and downloaded from the Oklahoma Department of Libraries website (Ref. 6). Sanborn maps of the subject property and adjoining properties were found for 1912, 1925, 1927, 1933, and 1949. All the Sanborn maps are located in Appendix C. The following represents a summary of what was found at the subject property and adjoining properties from each Sanborn map. The Sanborn maps previous to 1933 show no development in the subject property area. However, the Sanborn Map of 1927 shows a Service Station, a Battery service and Auto Repairing Store within 1 mile west to the subject property area. According to the 1933 and 1949 Sanborn Fire Insurance Phase I TBA Seminole Armory Seminole, Oklahoma 15 map, the property area was known as Magnolia Lake. The maps did not indicate the location of any USTs or other environmental concern. 3.9 Current and Past Uses of Adjoining Properties Sanborn maps showed that the adjoining properties were formerly residential, commercial or vacant property. Additionally, Sanborn maps showed that the area was formerly surrounded by the Magnolia Lake. An aerial photograph shows the area to the south had oil tanks in 1938. During the site visit on September 9, 2010, adjoining properties were observed to contain the following. The adjacent properties to the south and west are recreational properties that include several baseball fields. The adjacent area to the north and east are currently undeveloped. 3.11 Environmental (Physical) Setting The DEQ reviewed several sources to obtain information on the physical setting of the subject property and its surrounding areas. These sources include: The United States Department of Agriculture Oklahoma County Soil Survey, Oklahoma Geological Survey, and the Federal Emergency Management Association. Review of the physical setting of the area is to evaluate the sensitivity of the hydrogeology to potential contamination from sources either on or near the site. 3.11.1 Surface Water Characteristics The topography of the area is relatively flat. The Seminole Armory is located at a surface elevation of approximately 850 feet above mean sea level. The topographical gradient is to the south-southeast, toward Magnolia Creek. Magnolia Creek is located approximately 0.2 miles east of the site. Wewoka Creek is located 0.7 miles south of the subject property. No surface water bodies are on the subject property or the adjoining properties. According to the 1933 and 1949 Sanborn Fire Insurance map, the property area was known as Magnolia Lake. According to the Federal Emergency Association, the subject property is in an area outside the 500 year flood plain. According to FEMA (Ref. 15), Zone X is outside the flood plain. The structure lies outside of the flood boundary line. A map of this information is located in Appendix D. 3.11.2 Subsurface Geological Characterization Phase I TBA Seminole Armory Seminole, Oklahoma 16 According to the Soil Survey of Seminole County, Oklahoma, the subject property consists mainly of severely eroded Stephenville-Darnell complex soil. Stephenville soils comprise around 80% and are characterized by a slope of 5 to 15 percent, a water table depth of more than 80 inches, and a low available water capacity. Darnell soils comprise 10% of the subject property area of interest and are characterized by a slope of 5 to 15 percent, a water table depth of more than 80 inches, and very low available water capacity. The remaining 10% are comprised by severely eroded Niotaze (4%), Eram (2%), Grainola (2%) and Seminole soils (2%) (Ref. 17). 3.11.3 Ground Water Characteristics The groundwater aquifer in this area is the Vamoosa Formation and Ada Group. Maximum yield is approximately 50-150 gallons per minute. Water quality of the aquifer is generally fair or poor with high values of total dissolved solids. A study conducted by the Oklahoma geological survey in 1986 found that the aquifer is impacted with brine contamination (Ref. 7). Brine contamination in this aquifer may be a localized event and could be due to rise in the water levels and could be a result from oil exploration. Oklahoma Water resources board states that groundwater aquifers in this area are generally encountered at approximately 500- 1000 feet below ground surface. The direction of the hydraulic gradient is generally to the east but locally is toward gaining streams. The direction of the confined area most likely flows west following the homoclinal dip. The shallow groundwater flow is often related to the surface topography. Therefore, the expected shallow groundwater flow direction would be to the south-southeast. 3.11.4 Air Characteristics No air emissions were noticed at the subject property or the adjoining properties. The DEQ dataviewer database was searched for Air Quality Permitted Facilities (AQPF). No AQPF were found within 1 mile radius from the subject property. Buster Wilcox had no knowledge of any air emissions on the subject property (Ref. 5). No odors were noticed outside of the subject property during the site visit. There is a potential for lead dust and asbestos emissions from the subject property. 4.0 RECORDS REVIEW A regulatory database search was conducted by the DEQ. This search included, at a minimum, those records and distances from the site dictated as appropriate in the ASTM standard. The DEQ performed a review of available federal and state databases to assess whether the subject property or proximate properties were listed as having environmental concerns, which could have an adverse impact on the subject property. The following provides a summary of the databases reviewed. Phase I TBA Seminole Armory Seminole, Oklahoma 17 4.1 Federal National Priorities List (NPL) The Environmental Protection Agency (EPA) database was searched for NPL sites near the subject property within the ASTM’s recommended search radius of one mile (Ref. 8). The subject property is not a listed NPL site. There are no NPL sites reported within a one-mile radius of the subject property. There is also an EPA database for Delisted NPL sites, which ASTM requires to be reported within ½ mile of the subject property (Ref. 9). No delisted NPL sites are within the ½ mile search radius. 4.2 Federal CERCLIS List The EPA database for Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) Information Systems (CERCLIS) was searched for active and archived CERCLIS sites on and near the subject property (Ref. 10). The ASTM’s recommended search radius of the subject property for both active and archived CERCLIS sites is ½ mile. No active CERCLIS sites were found within ½ mile of the subject property. The subject property is not listed on the archived CERCLIS list. TJ’s Swap Shop (EPA ID# OKN000607079), located 100 S. Milt Phillips Hwy 99, and Semi Mercury (EPA ID# OKN000606804), located at 12362 North South 353 are the closest archived sites. The status of both of these sites is No Further Remedial Action Planned. A preliminary assessment and site inspection of the TJ’s Swap Shop was conducted on March 19, 2010, and was archived May 5, 2010. EPA conducted an Emergency Response at the Semi Mercury facility on July 5, 2007, and the site was archived on July 10, 2007 (Ref. 12). 4.3 Federal RCRA CORRACTs List The EPA database for Resource Conservation and Recovery Act (RCRA) facilities subject to corrective action was searched within the ASTM’s required minimum distance of one mile of the subject property (Ref. 11). No RCRA CORRACT facility was found within the one-mile radius of the subject property. 4.4 Federal RCRA non-CORRACTS TSD List The EPA database for RCRA facilities not subject to corrective action was searched within the ASTM’s required minimum distance of ½ mile of the subject property (Ref. 11). No RCRA non-CORRACT Treatment, Storage and Disposal (TSD) sites are within the ½ mile radius of the subject property. 4.5 Federal RCRA Generators List The EPA RCRA Notifiers database was searched for RCRA generators within the ASTM’s required minimum search distance of the subject property (Ref. 11). The Phase I TBA Seminole Armory Seminole, Oklahoma 18 minimum distance is the property and adjoining properties. The subject property did not have any RCRA notifiers or generators. However, there were seven facilities found near the subject property. No large quantity generators were reported within the subject property and its adjoining properties. United Motors located on 1405 N Milt Phillips northwest of the subject property. Seminole Ford Mercury located northwest of the subject property on 2222 N Milt Phillips. The facility is designated as a conditionally exempt small quantity generator. Parks Manufacturing, Inc. located west of the subject property on 711 Boren Blvd. The facilities were found in the database as active small quantity generators. Arrow Pump and Supply located south of the subject property on 101 N Main. Halliburton Services located east of the subject property on Hwy 270 3M E. Koch Pipeline Co. LP-Olympic located south of the property on 9 Mi East of Seminole Hwy 48. Wal-Mart Supercenter #123 northeast of the subject property located on 1500 E Wrangler Blvd. The facilities were found in the database as active conditionally exempt small quantity generators. 4.6 Federal ERNS List Emergency Response Notification system (ERNS) maintained by the National Response Center was searched for any hazardous substance releases or spills within the subject property (Ref. 12). ASTM requires a minimum search distance of property only when identifying ERNS cases. No ERNS sites were reported within the property or the adjoining properties. The ERNS data is included in Appendix K. 4.7 Federal Institutional Control/Engineering Control Registries There are no known Institutional Controls/Engineering Controls on the subject property according to the representatives of the subject property and a search of county land records. 4.8 State-Equivalent NPL The DEQ does not have a State-equivalent NPL database. Oklahoma does not have a State Superfund law to establish a State-equivalent NPL database. 4.9 State-Equivalent CERCLIS The DEQ does not have a State-equivalent CERCLIS database. 4.10 State Landfill and / or Solid Waste Disposal Sites The DEQ regulates landfills and solid waste disposal sites across the State of Oklahoma (Ref. 13). State landfills and solid waste disposal facilities were searched in the DEQ database within the ASTM required minimum distance ½ mile from the subject property. Phase I TBA Seminole Armory Seminole, Oklahoma 19 No permitted landfills or solid waste disposal facilities are located within the search distance of the subject property. 4.11 State Leaking UST List The Oklahoma Corporation Commission UST Notification Database was searched to locate any known leaking underground storage tanks (LUSTs) sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. Seven LUST sites were found within the ½ mile radius. The following sites are listed and described below. • The 1st National Bank and Trust, located at 201 N Milt Phillips, is southwest of the subject property. The LUST case Facility ID number is 6713035. • The Former Happy Foods #3, located at 601 N Milt Phillips, is southwest of the subject property. The site was reported on January 17, 1993 and closed on October 19, 1999. The LUST case Facility ID number is 6705317. • The Former Bowling Oil Co site, located at 700 N Milt Phillips, is west-southwest of the subject property. The site was reported on January 1997 and closed in March 20 of 2009. The LUST case Facility ID number is 6710631. • The Former Service station, located at 828 Milt Phillips, is west of the subject property. The site was closed on July 25, 2003. The LUST case Facility ID number is 6721142. • The Biofuels Express #1, located at 401 W Strother, is west of the subject property. The LUST case Facility ID number is 6704054. • The 420 One Stop, located at 420 N Milt Phillips Ave, is southwest of the subject property. The site was reported on April 29, 1992 and closed on October 25, 1994. The LUST case Facility ID number is 6706612. • The Zipomatic Auto Repair, located at 914 E Broadway, is south of the subject property. The LUST case Facility ID number is 6702943. 4.12 State Registered UST Sites The Oklahoma Corporation Commission UST Notification Database was searched to locate registered underground storage tanks (UST) located within the ASTM’s minimum search distance of the subject property and its adjoining properties. Nine registered USTs were found on the adjoining properties. For a list of registered UST sites, see Section 4.11. The subject property formerly contained a 1,000 gallon gasoline UST on the property. The UST was removed August 29, 1997 from the subject property (Appendix L). No leaks were reported to the OCC for the UST. Following the tank removal the soil Phase I TBA Seminole Armory Seminole, Oklahoma 20 was sampled from the below the former fuel island and the center of the tank pit. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380 mg/kg and 20 mg/kg, respectively. Soil samples showed no diesel range organics present in the UST excavation. No information regarding the remediation of the contaminated island soil was found. However, the site was closed within prescribed standards by OCC on December 31, 1997. This is considered a historic REC due to the potential soil and groundwater impacts. For a map of UST sites near the subject property, see Appendix A. 4.13 State Institutional Control/Engineering Control Registries The State Institutional Control/Engineering Control Registry is currently under development by the DEQ. There are no known Institutional Control/Engineering Controls in effect for this property. 4.14 State Voluntary Cleanup Sites The DEQ Voluntary Cleanup Program (VCP) database was searched for VCP sites within the required ASTM search distance of ½ mile of the Seminole Armory (Ref. 14). No VCP sites are located on or within ½ mile of the subject property. 4.15 State Brownfield Sites The DEQ Brownfield database was searched for Brownfield sites within the required ASTM search distance of ½ mile of the Seminole Armory (Ref. 14). No Brownfield sites were found within ½ mile of the Seminole Armory. 4.16 Oil and Gas Records The subject property is located in the NW ¼ NE ¼ NW ¼ of Section 27 T09N R6E. The DEQ performed a search of oil and gas records from the Oklahoma Corporation Commission’s (OCC) oil and gas records database. The subject property is in an area where there is a history of oil and gas development. Oil and gas records were searched to record the known history of well development on and near this site. A search area consisted of the property as described from the legal location above and the quarter, quarter, quarter sections directly above and upgradient of the site. The following describes each well record found in adjacent areas. Additional wells near the area are located in Appendix H. • The Fee #1 was located in the SW ¼ of the SE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion record, drilling finished on November 18, 1927. The operator for the well was Crystal Oil. According to the plugging record, plugging was not completed on this site. This well would have been near the subject property when it was in operation. According to the OCC database this well is active, completed and probably producing. However, the OCC could not find any information regarding the Phase I TBA Seminole Armory Seminole, Oklahoma 21 production or closure of the well. There is a possibility that this well was never plugged. In that case, this well is considered a historic REC. • The Strothers O D #1 was located in the SE ¼ of the SE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on April 27, 1927 and finished on July 22, 1927. The operator for the well was listed as Independent O&G. No plugging records were found for this well. This well would have been very near the subject property when it was in operation. According to the OCC database this well is active, completed and probably producing. However, the OCC could not find any information regarding the production or closure of the well. There is a possibility that this well was never plugged. In that case, this well is considered a historic REC. • The Bishop #1 was located in the NE ¼ of the NE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on August 17, 1943 and finished on September 05, 1943. According to the plugging record found, plugging was completed on this well on September 09, 1943. The company operating the well at this time was Wood Oil Company. This well would have been very near if not on the subject property when it was in operation. • The Gilliland J #1 was located in the NE ¼ of the NW ¼ of the NE ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on January 13, 1927, and drilling finished on March 26, 1927. The company operator for the well was listed as The Carter Oil Company. According to the plugging record found, plugging was completed on this well on September 29, 1971. This well would have been very near if not on the subject property when it was in operation. • The Gilliland J #2 was located in the SE ¼ of the NW ¼ of the NE ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on April 20, 1927, and drilling finished on August 1, 1927. The company operator for the well was listed as The Carter Oil Company. According to the plugging record, plugging was completed on February 25, 1928. The company operating the well at this time was listed as Continental Oil Company. This well would have been located due east of the subject property. 5.0 SITE RECONNAISSANCE AND INTERVIEWS 5.1 Methodology and Limiting Conditions A site reconnaissance of the subject property located on the southeast corner of East Strother Avenue and Main Street was performed on September 9, 2010. Beatriz Santamaria and Dustin Davidson of the DEQ met the building occupant of the property, Buster Wilcox (Vice-Commander, American Legion), and Terry Little (Commander, Phase I TBA Seminole Armory Seminole, Oklahoma 22 American Legion) at the property. Mr. Wilcox introduced Santamaria and Davidson to the site and answered questions to the best of his knowledge on the site. Mr. Wilcox and Mr. Little lead Santamaria and Davidson inside the building and gave their knowledge about what the building was used for and what kinds of activities occurred there in the past. All areas of the building were observed noting any environmental conditions that might need additional investigation. The entire outside area of the subject property was walked through for observations that might need additional investigation as well. 5.2 General Site conditions The former Seminole Armory Property is composed of a rock building of approximately 11,216 square feet. The armory does not have an indoor firing range (IFR). It was built in 1953. The building is occupied by the American Legion. The property surrounding the building consists of a grassy area to the north; a baseball field to the west; paved vehicle ramp, a small gravel parking area, and baseball field to the south; and a grassy area to the east. The subject property is in town and paved streets are located to the north and east of the subject property. The following are general site conditions that were evaluated on the property and adjacent properties. Aboveground Storage Tanks (ASTs) The subject property contains a propane tank on site. No ASTs were found on the adjacent properties during the site reconnaissance. Landfills and/or Dumping No landfills, dumping, or disturbed soil was found on the property. There is an empty dumpster onsite. This is accessible from the road and therefore could be a source of future dumping. Impoundments No impoundments were observed at the subject property. However, Sanborn maps showed the subject property used to be part of the Magnolia Lake. No information was found regarding fill brought from other locations to bring the lake up to grade. Monitoring Wells No monitoring wells are present on the property. According to the Oklahoma Water Resources Board well search, performed on August 31, 2010, there are 27 monitoring wells within 1 mile of the subject property. These wells were installed for groundwater monitoring. One of these three wells is located upgradient whereas the rest are downgradient of the subject property. See Appendix A for a map of OWRB wells found within 1 mile of the subject property. Phase I TBA Seminole Armory Seminole, Oklahoma 23 Disturbed and Stained Soils No stained soils were observed at the subject property; however minimal soil disturbance was noted. Seeps No seeps of any kind were observed at the subject property. Chemical Spills No evidence of possible chemical spills was observed on the subject property. Farm Waste No farm waste was observed at the subject property. Known Pesticide Misapplication No known pesticide misapplications were detected during the site visit or during the supportive research. Discharges and Runoff from Adjacent Property Affecting the Site Rainwater runs off the east of the subject property. DEQ observed pooled water in the concrete floor of the Drill Hall that may be due to rain events. No potential pollutants were observed on the neighbor’s properties that may affect the armory. Petroleum Products and Oil and Natural Gas Exploration No petroleum products or oil and natural gas exploration was observed during the site visit. Asbestos Since many of the State armories were built before the 1970s, there is a high potential of finding asbestos containing material (ACM) in the armory buildings. The U.S. began banning the use of asbestos in most building products in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. ACM may be found in the insulation wrapping of the heating pipes and/or heaters, roofing materials, ceiling tiles, window putty, mastic, and floor tiles. Floor tiles that are 9 x 9 inches have been found to regularly contain asbestos. The building may contain ACM; however, DEQ’s contractor is in the process of sampling and analyzing asbestos, lead dust and lead-based paint assessment in the Phase I TBA Seminole Armory Seminole, Oklahoma 24 armory. Twelve inch by Twelve inch tiles were found on the first floor in the northeast corner room. The tiles appear to be in good to fair condition and nonfriable. The window seal putty throughout the facility may contain asbestos. This material is usually suspect for ACM. Thermal system insulation was observed and could be present on some of the utility pipes in the building. Lead The building most likely contains lead-based paint and lead dust. Surveys for lead-based paint and lead dust throughout the building were conducted by Enercon on October 19, 2010. The results have not been received by the DEQ. However, there is a potential for lead based paint and lead dust in the building. There is no IFR in this building, so any lead dust is most likely due to deteriorated lead-based paint. Lead-based paint could be present on doors, door frames, handrails, windows, window bars, wall trim, walls, overhead door frames, and downspouts in various places inside and outside of the building. Transformers/PCB Equipment There were some transformers observed around the subject property. All transformers are in good condition and have no damage. According to Buster Wilcox (Ref. 5), the transformers are owned by the City of Seminole. It is unknown if the transformers contain PCBs. No other Polychlorinated biphenyl (PCB) contamination or other PCB-containing equipment was observed at the site. Fluorescent lighting ballasts were found throughout the entire building. It is unknown if the ballasts contain PCBs. None of the ballasts appeared to have leaks. 5.2 External Observations The external observations showed no recognized environmental conditions. The area is composed of a concrete driveway with grass vegetation covering the rest of the site. The area around the building is considered residential area. The east side of the building consists of grass vegetation and a gravel driveway. The south side of the building is vegetated with grass and has a concrete/gravel driveway. The west side of the building represents the entry driveway and it is also vegetated. A radiation sign was observed at the entrance of the building. Samples for radiation products were taken on October 9 by DEQ, however sample results are still pending. No visible indication was observed of where the UST was previously located. Photographs of the external view of the site can be found in Appendix F. 5.3 Internal Observations The building is currently occupied by the American Legion and was last used by the Oklahoma Army National Guard to support the military mission. The one story building was constructed from native rock in 1953. Before construction of the armory building, Phase I TBA Seminole Armory Seminole, Oklahoma 25 the land was owned by the American Legion and was vacant land. During the site visit on September 9, 2010, small pools of standing water were observed in the south part of the Drill Hall. However, no holes were observed in the roof. No floor drains were noted at that time. Ceiling hung heaters were present in the Drilling Floor ceiling. No chemicals or military equipment were observed on site. A vault was observed and may have served as storage for radioactive material as indicated by a sign posted at the vault door. Photographs of the internal view of the site can be found in Appendix F. 5.4 Interviews Buster Wilcox from the American Legion gave a tour of the Armory and provided historical and environmental information about the site. He is the current occupant of the building, has been involved with the armory building for a few years and therefore is a good point of contact for knowledge of the building. He was not aware of any present environmental concerns of the property or adjacent properties. Below is the information obtained from Mr. Wilcox (Appendix F): • There has been no industrial use of the subject property or surrounding areas in the past. • Mr. Wilcox knows of no chemical spills on the property. To his knowledge, the only chemicals used at the facility were for housekeeping purposes and automotive maintenance. • No drums or storage tanks have been present on the property to the knowledge of Mr. Wilcox. • Mr. Wilcox suggested that oil and gas wells had been present nearby in the past but not currently. • Hazardous substances may include lead based paint, lead dust and asbestos. • The American Legion will like to use the building for commercial purposes. 6.0 FINDINGS Summarized below are the major findings from this Targeted Brownfield Assessment and DEQ’s recommendations. The major findings of the highest environmental concern are presented first. • The former Seminole Armory was built in 1953. The land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard. The subject property is currently owned by the State of Oklahoma. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A Memorandum of Agreement (MOA) will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse. • Historic recognized environmental conditions (REC) are the old, abandoned, potentially unplugged oil wells. Phase I TBA Seminole Armory Seminole, Oklahoma 26 • The building is probably contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program plans to remediate any lead and asbestos contamination on the subject property and properly dispose of all associated waste. The possible lead and asbestos contamination in the building may constitute a recognized environmental condition (REC). • The property formerly contained a 1,000 gallon underground storage tank (UST) that was removed August 29, 1997. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380 mg/k and 20 mg/kg, respectively. The former UST and associated contamination constitutes a historically recognized environmental condition (HREC). • Adjoining properties consist of baseball fields and undeveloped land. Historical aerial photographs show parks surrounding the subject property. • Sanborn Fire Insurance maps showed that the subject property was vacant land before the armory was built with the presence of Magnolia Lake between 1933 and 1949. Adjacent properties consisted of undeveloped areas and a commercial sector. Sanborn maps revealed that a National Guard Armory occupied a small office space on E Broadway Street near the intersection of Main Street. This property is separate from the property being investigated in this Targeted Brownfield Assessment. • No National Priority List (NPL), delisted NPL sites, Resource Conservation and Recovery Act (RCRA) non-corrective action sites (CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) list, Institutional Controls/Engineering Controls, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM recommended search radii. No RCRA generators, Voluntary Cleanup (VCP) sites, or Brownfield sites were found on the subject property. The subject property is on the DEQ Site Cleanup Assistance Program (SCAP) list for cleanup of lead and asbestos contamination. There were seven RCRA generators listed within one mile of the subject property, and two archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) site listings. • Thirty-one underground storage tank sites were found within a ½ mile radius of the subject property. The UST sites are located east, west, southwest, and northwest of the subject property. The closest USTs to the subject property are located within one or two blocks from the subject property and are listed as permanently out of use. It is unknown if those tanks have been removed. Of the thirty-one USTs, four sites have current and historic leaking underground storage tank cases. • Oil and gas development was found in the OCC oil and gas records for the quarter, quarter, quarter sections directly above and upgradient of the site. • Pole mounted transformers, in good condition without any leaks, are located around the armory building. It is unknown if these transformers contain PCBs. Fluorescent lighting Phase I TBA Seminole Armory Seminole, Oklahoma 27 ballasts are located throughout the building. The lighting ballasts are all in good condition. It is unknown if the lighting ballasts contain PCBs. 7.0 OPINION AND RECOMMENDATIONS Due to the past use of the property and contamination found on the subject property, the environmental professionals working on this site believe that cleanup of lead and asbestos will be necessary. DEQ feels there is a low potential of impact from the LUST cases due to the distance they are located from the site. None of these LUST cases were found on the adjoining properties either. It is not believed that nearby LUST sites pose a threat, because they are listed as permanently out of use and have no associated LUST cases. The UST located in the subject property was removed according to prescribed standards by OCC on December 31, 1997. This is considered a historic REC due to the potential soil and groundwater impacts. However, based on the investigation DEQ feels there is a low potential of impact to the site from the LUST and UST sites. Two of the oil wells located near the subject property area may not be plugged, representing a safety hazard. The OCC could not find any information regarding the production or closure of these wells. In that case these wells are considered historic RECs. 8.0 DATA GAPS No tribal information was obtained for this assessment. No tax records, city directories, or zoning records were reviewed for this report. The Limited Environmental Baseline Assessment (LEBA) had not been completed by the Oklahoma Military Department at the time this TBA was conducted. However, this did not affect the ability of the DEQ to make a recommendation on the subject property. 9.0 CONCLUSIONS DEQ has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-05 of the former Seminole armory located at 600 E. Strothers Ave. Seminole, Oklahoma. Any exceptions to, or deletions from, this standard are described in Section [10.0] of this report. Recognized environmental conditions on this property include lead dust, lead-based paint, and asbestos contamination throughout the building. The information provided in this assessment is to assist the American Legion in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfields Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3). ADDITIONAL SERVICES In addition to this Phase I Targeted Brownfield Assessment, DEQ will provide sampling analysis of potential asbestos, lead-based paint, and lead dust sources including the remediation of the building. 11. Full text | TARGETED BROWNFIELD ASSESSMENT For Oklahoma Army National Guard Former Seminole Armory Seminole, Oklahoma ASTM E 1527-05 Phase I Environmental Site Assessment All Appropriate Inquiry Prepared by: December 10, 2010 Phase I TBA Seminole Armory Seminole, Oklahoma 3 Background and Disclaimer: The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability or land use restrictions. The ASTM Phase I Environmental Site Assessment E 1527 – 05 is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the redevelopment project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. The subject property is situated next to the American Legion Park in Seminole. The purpose of the TBA was to identify potential environmental concerns by reviewing historical data, regulatory information, and by performing a visual inspection of the site and surrounding area. The following is an executive summary of the environmental site assessment results: • Historic recognized environmental conditions (REC) include the old, abandoned, potentially unplugged oil wells. • The former Seminole Armory was built in 1953. The land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard. The subject property is currently owned by the State of Oklahoma. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A MOA will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse by the DEQ. • The building is probably contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program plans to cleanup any lead and asbestos contamination on the subject property and properly dispose of all associated waste. The possible lead and asbestos contamination in the building may constitute a recognized environmental condition (REC). • The property formerly contained a 1,000 gallon underground storage tank (UST) that was removed August 29, 1997. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380mg/k and 20 mg/kg, respectively. The former UST and associated contamination constitutes a historically recognized environmental condition (HREC). • Adjoining properties consist of baseball fields and undeveloped land. Historical aerial photographs show parks surrounding the subject property. ��� Sanborn Fire Insurance maps showed that the subject property was vacant land before the armory was built. A lake surrounded the vacant land between 1933 and 1949. Adjacent properties consisted of undeveloped areas and a commercial sector. Sanborn maps revealed that a National Guard Armory occupied a small office space on E Broadway Street near the intersection of Main Street. This property is separate from the property being investigated in this Targeted Brownfield Assessment. • No National Priority List (NPL), delisted NPL sites, Resource Conservation and Recovery Act (RCRA) non-corrective action sites (CORRACTS) treatment, storage, and Phase I TBA Seminole Armory Seminole, Oklahoma 7 disposal (TSD) listings, Emergency Response Notification System (ERNS) list, Institutional Controls/Engineering Controls, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM recommended search radii. No RCRA generators, Voluntary Cleanup (VCP) sites, or Brownfield sites were found on the subject property. The subject property is on the DEQ Site Cleanup Assistance Program (SCAP) list for cleanup of lead and asbestos contamination. There were seven RCRA generators listed within one mile of the subject property, and two active or archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) site listings. • Thirty-one underground storage tank sites were found within a ½ mile radius of the subject property. The UST sites are located east, west, southwest, and northwest of the subject property. The closest USTs to the subject property are located within one or two blocks from the subject property and are listed as permanently out of use. It is unknown if those tanks have been removed. Of the thirty-one USTs, four sites have current and historic leaking underground storage tank cases. • Oil and gas development was found in the OCC oil and gas records for the quarter, quarter, quarter sections directly above and upgradient of the site. • Pole mounted transformers, in good condition without any leaks, are located around the armory building. It is unknown if these transformers contain PCBs. Fluorescent lighting ballasts are located throughout the building. The lighting ballasts are all in good condition. It is unknown if the lighting ballasts contain PCBs. All fluorescent bulbs contain mercury and should be handled as Universal Waste unless documentation and/or sampling demonstrate they are not hazardous. 2.0 INTRODUCTION The State of Oklahoma Department of Environmental Quality (DEQ) under a Brownfield Assistance Agreement (No. RP96681001-0) (Ref. 1) with the U.S. Environmental Protection Agency (EPA) conducted a Targeted Brownfield Assessment of a property located 600 E Strothers Ave, Seminole, Oklahoma. 2.1 Purpose The purpose of this assessment is to look at the environmental conditions within the target area and provide this information to the American Legion as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfield’s Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3). The purpose of a Phase I Environmental Site Assessment is to identify, to the extent feasible, recognized environmental conditions in connection with the target property through a systematic review of readily available information sources and a site reconnaissance. Phase I TBA Seminole Armory Seminole, Oklahoma 8 DEQ is providing technical assistance to the project by evaluating the environmental condition of the property prior to the American Legion owning the property. Funding for this assessment has been provided by the U.S. Environmental Protection Agency (EPA). 2.2 Detailed Scope-of-Services DEQ examined the current use of the property and then identified the historical uses of the property to determine if recognized environmental conditions exist. DEQ examined historical documents, governmental databases, oil and gas records, aerial photographs, Sanborn Fire Insurance Maps, and conducted interviews and a site reconnaissance of the area. A good faith effort was made to identify possible environmental conditions that might affect the development of the property. 2.3 Significant Assumptions History and knowledge of the subject property shows that the building was used as a National Guard Armory. Prior to armory construction in 1953, the property was vacant land owned by the neighboring American Legion. There has been no oil and gas exploration on the property according to Oklahoma Corporation Commission records. Since the building was constructed in 1953, the building is likely to contain asbestos containing materials (ACM). The U.S. began banning the use of asbestos in most building materials in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. Pipe wrap and suspect floor tile were observed in the building during the site reconnaissance conducted on September 9, 2010. It is also likely that the building contains lead-based paint. The DEQ plans to have a lead-based paint, lead dust and asbestos survey conducted on the property. 2.4 Limitations and Exceptions The purpose of an environmental site assessment is to identify actual or potential “recognized environmental conditions” that may result in liability, land use restrictions, or cause delays in revitalization. The ASTM Phase I Environmental Site Assessment E 1527 – 05 (Ref. 4) is the minimum standard for environmental due diligence in the commercial real estate industry and meets the standard for All Appropriate Inquiry under the Small Business Liability Relief and Brownfields Revitalization Act of 2002. A diligent effort in accordance with generally accepted good commercial and customary standards and practices was undertaken to identify the “recognized environmental conditions” that might affect the revitalization project. However, the identification of old hazardous waste sites is an evolving process; therefore, DEQ cannot state with absolute certainty that no other potential hazardous waste sites are located in the area. This assessment was conducted under constraints of time, cost, and scope and reflects a limited investigation and evaluation. It reflects the normal degree of care and skill that is ordinarily exercised by environmental professionals conducting business in this or similar localities. In no event shall the DEQ or its employees be liable for any damages, injury, loss, cost or Phase I TBA Seminole Armory Seminole, Oklahoma 9 expense whatsoever arising in connection with the use or reliance on the information contained in this report, except as otherwise provided by law. The information in this report is based on a review of governmental records, interviews with knowledgeable representatives of the property, information provided by the City of Seminole, and observations of the environmental professional. The result of this assessment, as written in this report, is valid as of the date of report. The assessment does not include sampling of rock, soil, groundwater, surface water, or air. For qualifications of environmental professionals see Appendix I. 2.5 Special Terms and Conditions This assessment report has been prepared for the American Legion by the DEQ using EPA funding. Information about this report will be provided to the EPA for its files. This report and the working file are public record and subject to the Oklahoma Open Records Act and the federal Freedom of Information Act. 3.0 SITE CHARACTERIZATION AND HISTORY 3.3 Location and Legal Description The subject property is located in the east quadrant of E Strother Avenue and N Main Street in Seminole, Oklahoma. This property consists of approximately 1.68 acres of land and contains the former National Guard Armory building. A site map and topographical map depicting the property have been provided in Appendix A. The subject property is located in the Northwest Quarter (NW/4) of the Northwest Quarter (NW/4) of Section 27, Township 9N, and Range 6E. The armory building’s legal location is described as 1796 ft East and 33 ft South of NW corner and 225 ft South, 325 ft East, 225 ft North and 325 ft West to the point of beginning of original plat to the City of Seminole, Seminole County, State of Oklahoma. Records at the Seminole County Courthouse were searched to determine ownership and operational history of the subject property. It was determined that the property was previously owned by the American Legion and deeded to the State of Oklahoma for the purpose of building a Oklahoma National Guard armory in 1953. Prior to 1953 the property was privately owned by several individuals. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A Memorandum of Agreement (MOA) will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse. Seminole County Courthouse Records showed the following history on the property. See Appendix C for copies of these documents. All documents reviewed at the county courthouse are located in Appendix J. Phase I TBA Seminole Armory Seminole, Oklahoma 10 • On July 1, 1912 the NW quarter of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to Maria Jackson by Principal Chief of Seminole Nation. Warranty Deed (WD). • On July 9, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to W.H. Lenfesty by Maria Jackson. WD • On August 02, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to W.H. Lenfesty by Maria Jackson. WD • On September 02, 1915 the west half of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9N, Range 6E of the Indian Base and Meridian were sold to Maria Jackson by W.H. Lenfesty. Presley by James Carter guardian of Maria Jackson a minor. • On February 1, 1916 the NW quarter of the NE quarter and the NE quarter of the NW quarter of Section 27, Township 9, and range 6E containing 80 acres also lot 1 to 14 inclusive in block 1 and lots 1 to 4 inclusive in block 4 to Batey Addition to Incorporated town, also beginning at the northeast corner of lot 1 block 1 to said Batey Addition above named running thence east 767 feet, thence south 685 feet thence west 767 feet to northeast corner of lot 13 in block 4 Batey Addition above described thence north 685 feet to point of beginning all being in the NW quarter of the NW quarter of Section 27, Twp. 9N, Range 6E containing 95 acres were sold to W. QCD • On February 6, 1925 the NE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to W. A. Bishop by H.H. Bishop and Louis Slover Bishop. QCD • On February 27, 1925 the NE quarter of the NW quarter and the North half of the SE quarter of the NW quarter of Section 27, Township 9, range 6E were sold to J.G. Berry by the Oklahoma State Bank of Konawa. QCD • On December 28, 1928 the NE quarter of the NW quarter of Section 27, Township 9, range 6E and the SW quarter of the SW quarter of section 22, Township 9N, Range 6E minus 8 acres in the SW corner of the above described tract of land were sold to W.A. Bishop by the Homer H. Bishop. QCD • On April 15, 1930 the NW quarter of the NE and the NE quarter of the NW quarter and lots 1 to 28 inclusive in Block 1, Bishop Addition to the City of Seminole, Oklahoma, and a tract of land beginning at the NE corner of Lot 1, Block 1, Bishop Addition above named, running thence due South to the North side of Walnut Street, thence West to the West Bank of the present creek channel where Walnut Street and the present creek intersect, thence along the West bank of the present creek channel to the SE corner of the NW corner of the NW quarter, thence due North to the NW corner of the NE quarter of the NW quarter, thence due west to point of beginning, containing approximately 95 acres, more or less, and the following described land. Phase I TBA Seminole Armory Seminole, Oklahoma 12 • On October 12, 1953 beginning at a point 1796 ft East and 33 ft South of NW corner and 225 ft South, 325 ft East, 225 ft North and 325 ft West to the point of beginning were sold to State of Oklahoma for benefit and use of the Oklahoma National Guard 3.4 Site and Vicinity Characterization The former Seminole Armory was built in 1953. According to Seminole County land records, the land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard (see Appendix C). The subject property is a small tract of land about one acre and a half in size. The subject property is located at 600 E Strothers Ave, Seminole, Oklahoma bound by E Strothers Ave on the north, Armory Drive on the West and E Seminole Ave on the south. The areas where the subject property and adjacent properties are located are best characterized by recreational development and undeveloped land. Undeveloped land surrounds the property to the north and east and the American Legion Park resides to the west and south of the property. A site vicinity map of the subject property can be found in Appendix A and C. Lead-based paint and asbestos may be present onsite due to the age of the building. Utilities that serve the subject property are CenterPoint Energy for natural gas and the OG&E electric, AT&T provides telephone services, and the City of Seminole provides sewer services to the armory according to Buster Wilcox, facility occupant for the American Legion (Ref.5). According to the Oklahoma Water Resources Board Water Information Mapping System, the subject property is served by the City of Seminole. A review of the topographical map indicated that the surface elevation of the site is approximately 850 feet above mean sea level. The topographical gradient is to the southeast, toward Magnolia Creek. The Magnolia Creek is located approximately 0.2 miles east of the site. Wewoka Creek is located 0.7 miles south of the subject property. The Magnolia Lake used to surround the property during 1933-1949. However, the subject property was never flooded. Magnolia Lake is reduced in size and resembles a pond and is located to the southwest of the property. The topographical map can be found in Appendix A. 3.5 Description of Structures, Roads, and Other Improvements The structure of the Armory is in good condition. The roof of the Drill Floor is in excellent condition. According to Buster Wilcox, the Drill Floor roof was replaced. There was only one observed damaged window at the Armory. Roads surrounding the Armory are in good condition. All roads are constructed of asphalt pavement. Adjacent properties, which consist of a park and undeveloped land, are in good condition. Throughout the facility, there are floor drains. Based on previous armories, it is thought that these drains lead into the city sanitary sewage pipes, but at the time of this report that could not be confirmed. Phase I TBA Seminole Armory Seminole, Oklahoma 13 3.6 Owner, Property Manager, and Occupant Information The subject property is owned by the State of Oklahoma and is occupied by the American Legion. The DEQ Site Cleanup Assistance Program (SCAP) is in charge of identifying environmental hazards and conducting the cleanup of the Armory. The Military department will transfer ownership of the armory to the American Legion prior to completion of remedial activities. 3.7 Information Reported by User Regarding Environmental Lien or Specialized Knowledge or Experience The property owner and/or representatives reported no environmental liens on the subject property, and had no specialized knowledge or experience regarding recognized environmental conditions. The DEQ conducted a search for environmental liens at the Seminole County Courthouse. No environmental liens or use limitations were reported for the subject property. 3.8 Commonly Known or Reasonably Ascertainable Information Buster Wilcox, representative of the American Legion, had no exceptional knowledge of commonly known or reasonably ascertainable information within the local community about possible environmental conditions on the property. It is known within the community that the building functioned as a National Guard Armory. 3.9 Valuation Reduction for Environmental Issues Valuation of the property is outside the scope of this assessment. A professional appraiser should be consulted to place a value on the property. 3.10 Current Use of the Property The buildings are currently being used as storage by the American Legion and Emergency Management Services (EMS). The office located in the north of the property is currently used by the EMS as an office. A trailer with a boat is stored inside the west building. The rest of the property is vacant land. 3.11 Past Use of the Property 3.9.1 Review of Aerial Photographs Historic aerial photographs were searched to view the changes to the property over time. Aerial photographs were obtained from the Department of Libraries and the DEQ database of archived and present-day photographs. Aerial photographs from 1938, 1956, 1995, 2003, and 2008 were obtained. All these photographs are located in Appendix B. The following represents a summary of what was found at the subject property from each photograph. Phase I TBA Seminole Armory Seminole, Oklahoma 14 1938 aerial photograph The 1938 aerial photograph shows the subject property to be near an area of oil and gas production. Five tanks were located southeast of the subject property. The adjoining property to the north was undeveloped. Sanborn maps show the surrounding area to the subject property was developed as the Magnolia Lake. However, the subject property area was not flooded. Commercial buildings were located west of the property. 1956 aerial photograph The 1956 aerial photograph shows the subject property with two distinct buildings. The tanks that were present on the southeast area of the subject property were removed by 1956. The adjoining property to the north was undeveloped. The areas to the west and south were developed as commercial and residential areas. 1995 aerial photograph The 1995 aerial photograph shows some changes from the 1956 aerial photograph. There is some residential and commercial development to the east of the subject property. It was also noted a park development north to the subject property. No apparent environmental conditions were noted from the photograph. 2003 aerial photograph The 2003 aerial photograph shows some changes from the 1995 aerial photograph. The photograph shows commercial development to the northeast of the subject property. No apparent environmental conditions were noted from the photograph. 2008 aerial photograph The 2008 aerial photograph shows some changes from the 2003 aerial photograph. The west and south areas adjacent to the subject property were developed as baseball fields. The remaining areas were unchanged from the 2003 aerial photograph. 3.9.2 Fire Insurance Maps Sanborn Fire Insurance maps were viewed and downloaded from the Oklahoma Department of Libraries website (Ref. 6). Sanborn maps of the subject property and adjoining properties were found for 1912, 1925, 1927, 1933, and 1949. All the Sanborn maps are located in Appendix C. The following represents a summary of what was found at the subject property and adjoining properties from each Sanborn map. The Sanborn maps previous to 1933 show no development in the subject property area. However, the Sanborn Map of 1927 shows a Service Station, a Battery service and Auto Repairing Store within 1 mile west to the subject property area. According to the 1933 and 1949 Sanborn Fire Insurance Phase I TBA Seminole Armory Seminole, Oklahoma 15 map, the property area was known as Magnolia Lake. The maps did not indicate the location of any USTs or other environmental concern. 3.9 Current and Past Uses of Adjoining Properties Sanborn maps showed that the adjoining properties were formerly residential, commercial or vacant property. Additionally, Sanborn maps showed that the area was formerly surrounded by the Magnolia Lake. An aerial photograph shows the area to the south had oil tanks in 1938. During the site visit on September 9, 2010, adjoining properties were observed to contain the following. The adjacent properties to the south and west are recreational properties that include several baseball fields. The adjacent area to the north and east are currently undeveloped. 3.11 Environmental (Physical) Setting The DEQ reviewed several sources to obtain information on the physical setting of the subject property and its surrounding areas. These sources include: The United States Department of Agriculture Oklahoma County Soil Survey, Oklahoma Geological Survey, and the Federal Emergency Management Association. Review of the physical setting of the area is to evaluate the sensitivity of the hydrogeology to potential contamination from sources either on or near the site. 3.11.1 Surface Water Characteristics The topography of the area is relatively flat. The Seminole Armory is located at a surface elevation of approximately 850 feet above mean sea level. The topographical gradient is to the south-southeast, toward Magnolia Creek. Magnolia Creek is located approximately 0.2 miles east of the site. Wewoka Creek is located 0.7 miles south of the subject property. No surface water bodies are on the subject property or the adjoining properties. According to the 1933 and 1949 Sanborn Fire Insurance map, the property area was known as Magnolia Lake. According to the Federal Emergency Association, the subject property is in an area outside the 500 year flood plain. According to FEMA (Ref. 15), Zone X is outside the flood plain. The structure lies outside of the flood boundary line. A map of this information is located in Appendix D. 3.11.2 Subsurface Geological Characterization Phase I TBA Seminole Armory Seminole, Oklahoma 16 According to the Soil Survey of Seminole County, Oklahoma, the subject property consists mainly of severely eroded Stephenville-Darnell complex soil. Stephenville soils comprise around 80% and are characterized by a slope of 5 to 15 percent, a water table depth of more than 80 inches, and a low available water capacity. Darnell soils comprise 10% of the subject property area of interest and are characterized by a slope of 5 to 15 percent, a water table depth of more than 80 inches, and very low available water capacity. The remaining 10% are comprised by severely eroded Niotaze (4%), Eram (2%), Grainola (2%) and Seminole soils (2%) (Ref. 17). 3.11.3 Ground Water Characteristics The groundwater aquifer in this area is the Vamoosa Formation and Ada Group. Maximum yield is approximately 50-150 gallons per minute. Water quality of the aquifer is generally fair or poor with high values of total dissolved solids. A study conducted by the Oklahoma geological survey in 1986 found that the aquifer is impacted with brine contamination (Ref. 7). Brine contamination in this aquifer may be a localized event and could be due to rise in the water levels and could be a result from oil exploration. Oklahoma Water resources board states that groundwater aquifers in this area are generally encountered at approximately 500- 1000 feet below ground surface. The direction of the hydraulic gradient is generally to the east but locally is toward gaining streams. The direction of the confined area most likely flows west following the homoclinal dip. The shallow groundwater flow is often related to the surface topography. Therefore, the expected shallow groundwater flow direction would be to the south-southeast. 3.11.4 Air Characteristics No air emissions were noticed at the subject property or the adjoining properties. The DEQ dataviewer database was searched for Air Quality Permitted Facilities (AQPF). No AQPF were found within 1 mile radius from the subject property. Buster Wilcox had no knowledge of any air emissions on the subject property (Ref. 5). No odors were noticed outside of the subject property during the site visit. There is a potential for lead dust and asbestos emissions from the subject property. 4.0 RECORDS REVIEW A regulatory database search was conducted by the DEQ. This search included, at a minimum, those records and distances from the site dictated as appropriate in the ASTM standard. The DEQ performed a review of available federal and state databases to assess whether the subject property or proximate properties were listed as having environmental concerns, which could have an adverse impact on the subject property. The following provides a summary of the databases reviewed. Phase I TBA Seminole Armory Seminole, Oklahoma 17 4.1 Federal National Priorities List (NPL) The Environmental Protection Agency (EPA) database was searched for NPL sites near the subject property within the ASTM’s recommended search radius of one mile (Ref. 8). The subject property is not a listed NPL site. There are no NPL sites reported within a one-mile radius of the subject property. There is also an EPA database for Delisted NPL sites, which ASTM requires to be reported within ½ mile of the subject property (Ref. 9). No delisted NPL sites are within the ½ mile search radius. 4.2 Federal CERCLIS List The EPA database for Comprehensive Environmental Response, Compensation and Liability Act (CERCLA) Information Systems (CERCLIS) was searched for active and archived CERCLIS sites on and near the subject property (Ref. 10). The ASTM’s recommended search radius of the subject property for both active and archived CERCLIS sites is ½ mile. No active CERCLIS sites were found within ½ mile of the subject property. The subject property is not listed on the archived CERCLIS list. TJ’s Swap Shop (EPA ID# OKN000607079), located 100 S. Milt Phillips Hwy 99, and Semi Mercury (EPA ID# OKN000606804), located at 12362 North South 353 are the closest archived sites. The status of both of these sites is No Further Remedial Action Planned. A preliminary assessment and site inspection of the TJ’s Swap Shop was conducted on March 19, 2010, and was archived May 5, 2010. EPA conducted an Emergency Response at the Semi Mercury facility on July 5, 2007, and the site was archived on July 10, 2007 (Ref. 12). 4.3 Federal RCRA CORRACTs List The EPA database for Resource Conservation and Recovery Act (RCRA) facilities subject to corrective action was searched within the ASTM’s required minimum distance of one mile of the subject property (Ref. 11). No RCRA CORRACT facility was found within the one-mile radius of the subject property. 4.4 Federal RCRA non-CORRACTS TSD List The EPA database for RCRA facilities not subject to corrective action was searched within the ASTM’s required minimum distance of ½ mile of the subject property (Ref. 11). No RCRA non-CORRACT Treatment, Storage and Disposal (TSD) sites are within the ½ mile radius of the subject property. 4.5 Federal RCRA Generators List The EPA RCRA Notifiers database was searched for RCRA generators within the ASTM’s required minimum search distance of the subject property (Ref. 11). The Phase I TBA Seminole Armory Seminole, Oklahoma 18 minimum distance is the property and adjoining properties. The subject property did not have any RCRA notifiers or generators. However, there were seven facilities found near the subject property. No large quantity generators were reported within the subject property and its adjoining properties. United Motors located on 1405 N Milt Phillips northwest of the subject property. Seminole Ford Mercury located northwest of the subject property on 2222 N Milt Phillips. The facility is designated as a conditionally exempt small quantity generator. Parks Manufacturing, Inc. located west of the subject property on 711 Boren Blvd. The facilities were found in the database as active small quantity generators. Arrow Pump and Supply located south of the subject property on 101 N Main. Halliburton Services located east of the subject property on Hwy 270 3M E. Koch Pipeline Co. LP-Olympic located south of the property on 9 Mi East of Seminole Hwy 48. Wal-Mart Supercenter #123 northeast of the subject property located on 1500 E Wrangler Blvd. The facilities were found in the database as active conditionally exempt small quantity generators. 4.6 Federal ERNS List Emergency Response Notification system (ERNS) maintained by the National Response Center was searched for any hazardous substance releases or spills within the subject property (Ref. 12). ASTM requires a minimum search distance of property only when identifying ERNS cases. No ERNS sites were reported within the property or the adjoining properties. The ERNS data is included in Appendix K. 4.7 Federal Institutional Control/Engineering Control Registries There are no known Institutional Controls/Engineering Controls on the subject property according to the representatives of the subject property and a search of county land records. 4.8 State-Equivalent NPL The DEQ does not have a State-equivalent NPL database. Oklahoma does not have a State Superfund law to establish a State-equivalent NPL database. 4.9 State-Equivalent CERCLIS The DEQ does not have a State-equivalent CERCLIS database. 4.10 State Landfill and / or Solid Waste Disposal Sites The DEQ regulates landfills and solid waste disposal sites across the State of Oklahoma (Ref. 13). State landfills and solid waste disposal facilities were searched in the DEQ database within the ASTM required minimum distance ½ mile from the subject property. Phase I TBA Seminole Armory Seminole, Oklahoma 19 No permitted landfills or solid waste disposal facilities are located within the search distance of the subject property. 4.11 State Leaking UST List The Oklahoma Corporation Commission UST Notification Database was searched to locate any known leaking underground storage tanks (LUSTs) sites located within the ASTM’s minimum search distance of a ½ mile of the subject property. Seven LUST sites were found within the ½ mile radius. The following sites are listed and described below. • The 1st National Bank and Trust, located at 201 N Milt Phillips, is southwest of the subject property. The LUST case Facility ID number is 6713035. • The Former Happy Foods #3, located at 601 N Milt Phillips, is southwest of the subject property. The site was reported on January 17, 1993 and closed on October 19, 1999. The LUST case Facility ID number is 6705317. • The Former Bowling Oil Co site, located at 700 N Milt Phillips, is west-southwest of the subject property. The site was reported on January 1997 and closed in March 20 of 2009. The LUST case Facility ID number is 6710631. • The Former Service station, located at 828 Milt Phillips, is west of the subject property. The site was closed on July 25, 2003. The LUST case Facility ID number is 6721142. • The Biofuels Express #1, located at 401 W Strother, is west of the subject property. The LUST case Facility ID number is 6704054. • The 420 One Stop, located at 420 N Milt Phillips Ave, is southwest of the subject property. The site was reported on April 29, 1992 and closed on October 25, 1994. The LUST case Facility ID number is 6706612. • The Zipomatic Auto Repair, located at 914 E Broadway, is south of the subject property. The LUST case Facility ID number is 6702943. 4.12 State Registered UST Sites The Oklahoma Corporation Commission UST Notification Database was searched to locate registered underground storage tanks (UST) located within the ASTM’s minimum search distance of the subject property and its adjoining properties. Nine registered USTs were found on the adjoining properties. For a list of registered UST sites, see Section 4.11. The subject property formerly contained a 1,000 gallon gasoline UST on the property. The UST was removed August 29, 1997 from the subject property (Appendix L). No leaks were reported to the OCC for the UST. Following the tank removal the soil Phase I TBA Seminole Armory Seminole, Oklahoma 20 was sampled from the below the former fuel island and the center of the tank pit. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380 mg/kg and 20 mg/kg, respectively. Soil samples showed no diesel range organics present in the UST excavation. No information regarding the remediation of the contaminated island soil was found. However, the site was closed within prescribed standards by OCC on December 31, 1997. This is considered a historic REC due to the potential soil and groundwater impacts. For a map of UST sites near the subject property, see Appendix A. 4.13 State Institutional Control/Engineering Control Registries The State Institutional Control/Engineering Control Registry is currently under development by the DEQ. There are no known Institutional Control/Engineering Controls in effect for this property. 4.14 State Voluntary Cleanup Sites The DEQ Voluntary Cleanup Program (VCP) database was searched for VCP sites within the required ASTM search distance of ½ mile of the Seminole Armory (Ref. 14). No VCP sites are located on or within ½ mile of the subject property. 4.15 State Brownfield Sites The DEQ Brownfield database was searched for Brownfield sites within the required ASTM search distance of ½ mile of the Seminole Armory (Ref. 14). No Brownfield sites were found within ½ mile of the Seminole Armory. 4.16 Oil and Gas Records The subject property is located in the NW ¼ NE ¼ NW ¼ of Section 27 T09N R6E. The DEQ performed a search of oil and gas records from the Oklahoma Corporation Commission’s (OCC) oil and gas records database. The subject property is in an area where there is a history of oil and gas development. Oil and gas records were searched to record the known history of well development on and near this site. A search area consisted of the property as described from the legal location above and the quarter, quarter, quarter sections directly above and upgradient of the site. The following describes each well record found in adjacent areas. Additional wells near the area are located in Appendix H. • The Fee #1 was located in the SW ¼ of the SE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion record, drilling finished on November 18, 1927. The operator for the well was Crystal Oil. According to the plugging record, plugging was not completed on this site. This well would have been near the subject property when it was in operation. According to the OCC database this well is active, completed and probably producing. However, the OCC could not find any information regarding the Phase I TBA Seminole Armory Seminole, Oklahoma 21 production or closure of the well. There is a possibility that this well was never plugged. In that case, this well is considered a historic REC. • The Strothers O D #1 was located in the SE ¼ of the SE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on April 27, 1927 and finished on July 22, 1927. The operator for the well was listed as Independent O&G. No plugging records were found for this well. This well would have been very near the subject property when it was in operation. According to the OCC database this well is active, completed and probably producing. However, the OCC could not find any information regarding the production or closure of the well. There is a possibility that this well was never plugged. In that case, this well is considered a historic REC. • The Bishop #1 was located in the NE ¼ of the NE ¼ of the NW ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on August 17, 1943 and finished on September 05, 1943. According to the plugging record found, plugging was completed on this well on September 09, 1943. The company operating the well at this time was Wood Oil Company. This well would have been very near if not on the subject property when it was in operation. • The Gilliland J #1 was located in the NE ¼ of the NW ¼ of the NE ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on January 13, 1927, and drilling finished on March 26, 1927. The company operator for the well was listed as The Carter Oil Company. According to the plugging record found, plugging was completed on this well on September 29, 1971. This well would have been very near if not on the subject property when it was in operation. • The Gilliland J #2 was located in the SE ¼ of the NW ¼ of the NE ¼ of Section 27, Township 09N, and Range 06E. According to the completion report, drilling started on April 20, 1927, and drilling finished on August 1, 1927. The company operator for the well was listed as The Carter Oil Company. According to the plugging record, plugging was completed on February 25, 1928. The company operating the well at this time was listed as Continental Oil Company. This well would have been located due east of the subject property. 5.0 SITE RECONNAISSANCE AND INTERVIEWS 5.1 Methodology and Limiting Conditions A site reconnaissance of the subject property located on the southeast corner of East Strother Avenue and Main Street was performed on September 9, 2010. Beatriz Santamaria and Dustin Davidson of the DEQ met the building occupant of the property, Buster Wilcox (Vice-Commander, American Legion), and Terry Little (Commander, Phase I TBA Seminole Armory Seminole, Oklahoma 22 American Legion) at the property. Mr. Wilcox introduced Santamaria and Davidson to the site and answered questions to the best of his knowledge on the site. Mr. Wilcox and Mr. Little lead Santamaria and Davidson inside the building and gave their knowledge about what the building was used for and what kinds of activities occurred there in the past. All areas of the building were observed noting any environmental conditions that might need additional investigation. The entire outside area of the subject property was walked through for observations that might need additional investigation as well. 5.2 General Site conditions The former Seminole Armory Property is composed of a rock building of approximately 11,216 square feet. The armory does not have an indoor firing range (IFR). It was built in 1953. The building is occupied by the American Legion. The property surrounding the building consists of a grassy area to the north; a baseball field to the west; paved vehicle ramp, a small gravel parking area, and baseball field to the south; and a grassy area to the east. The subject property is in town and paved streets are located to the north and east of the subject property. The following are general site conditions that were evaluated on the property and adjacent properties. Aboveground Storage Tanks (ASTs) The subject property contains a propane tank on site. No ASTs were found on the adjacent properties during the site reconnaissance. Landfills and/or Dumping No landfills, dumping, or disturbed soil was found on the property. There is an empty dumpster onsite. This is accessible from the road and therefore could be a source of future dumping. Impoundments No impoundments were observed at the subject property. However, Sanborn maps showed the subject property used to be part of the Magnolia Lake. No information was found regarding fill brought from other locations to bring the lake up to grade. Monitoring Wells No monitoring wells are present on the property. According to the Oklahoma Water Resources Board well search, performed on August 31, 2010, there are 27 monitoring wells within 1 mile of the subject property. These wells were installed for groundwater monitoring. One of these three wells is located upgradient whereas the rest are downgradient of the subject property. See Appendix A for a map of OWRB wells found within 1 mile of the subject property. Phase I TBA Seminole Armory Seminole, Oklahoma 23 Disturbed and Stained Soils No stained soils were observed at the subject property; however minimal soil disturbance was noted. Seeps No seeps of any kind were observed at the subject property. Chemical Spills No evidence of possible chemical spills was observed on the subject property. Farm Waste No farm waste was observed at the subject property. Known Pesticide Misapplication No known pesticide misapplications were detected during the site visit or during the supportive research. Discharges and Runoff from Adjacent Property Affecting the Site Rainwater runs off the east of the subject property. DEQ observed pooled water in the concrete floor of the Drill Hall that may be due to rain events. No potential pollutants were observed on the neighbor’s properties that may affect the armory. Petroleum Products and Oil and Natural Gas Exploration No petroleum products or oil and natural gas exploration was observed during the site visit. Asbestos Since many of the State armories were built before the 1970s, there is a high potential of finding asbestos containing material (ACM) in the armory buildings. The U.S. began banning the use of asbestos in most building products in the 1970s due to studies confirming the harmful health effects caused by exposure to airborne asbestos. ACM may be found in the insulation wrapping of the heating pipes and/or heaters, roofing materials, ceiling tiles, window putty, mastic, and floor tiles. Floor tiles that are 9 x 9 inches have been found to regularly contain asbestos. The building may contain ACM; however, DEQ’s contractor is in the process of sampling and analyzing asbestos, lead dust and lead-based paint assessment in the Phase I TBA Seminole Armory Seminole, Oklahoma 24 armory. Twelve inch by Twelve inch tiles were found on the first floor in the northeast corner room. The tiles appear to be in good to fair condition and nonfriable. The window seal putty throughout the facility may contain asbestos. This material is usually suspect for ACM. Thermal system insulation was observed and could be present on some of the utility pipes in the building. Lead The building most likely contains lead-based paint and lead dust. Surveys for lead-based paint and lead dust throughout the building were conducted by Enercon on October 19, 2010. The results have not been received by the DEQ. However, there is a potential for lead based paint and lead dust in the building. There is no IFR in this building, so any lead dust is most likely due to deteriorated lead-based paint. Lead-based paint could be present on doors, door frames, handrails, windows, window bars, wall trim, walls, overhead door frames, and downspouts in various places inside and outside of the building. Transformers/PCB Equipment There were some transformers observed around the subject property. All transformers are in good condition and have no damage. According to Buster Wilcox (Ref. 5), the transformers are owned by the City of Seminole. It is unknown if the transformers contain PCBs. No other Polychlorinated biphenyl (PCB) contamination or other PCB-containing equipment was observed at the site. Fluorescent lighting ballasts were found throughout the entire building. It is unknown if the ballasts contain PCBs. None of the ballasts appeared to have leaks. 5.2 External Observations The external observations showed no recognized environmental conditions. The area is composed of a concrete driveway with grass vegetation covering the rest of the site. The area around the building is considered residential area. The east side of the building consists of grass vegetation and a gravel driveway. The south side of the building is vegetated with grass and has a concrete/gravel driveway. The west side of the building represents the entry driveway and it is also vegetated. A radiation sign was observed at the entrance of the building. Samples for radiation products were taken on October 9 by DEQ, however sample results are still pending. No visible indication was observed of where the UST was previously located. Photographs of the external view of the site can be found in Appendix F. 5.3 Internal Observations The building is currently occupied by the American Legion and was last used by the Oklahoma Army National Guard to support the military mission. The one story building was constructed from native rock in 1953. Before construction of the armory building, Phase I TBA Seminole Armory Seminole, Oklahoma 25 the land was owned by the American Legion and was vacant land. During the site visit on September 9, 2010, small pools of standing water were observed in the south part of the Drill Hall. However, no holes were observed in the roof. No floor drains were noted at that time. Ceiling hung heaters were present in the Drilling Floor ceiling. No chemicals or military equipment were observed on site. A vault was observed and may have served as storage for radioactive material as indicated by a sign posted at the vault door. Photographs of the internal view of the site can be found in Appendix F. 5.4 Interviews Buster Wilcox from the American Legion gave a tour of the Armory and provided historical and environmental information about the site. He is the current occupant of the building, has been involved with the armory building for a few years and therefore is a good point of contact for knowledge of the building. He was not aware of any present environmental concerns of the property or adjacent properties. Below is the information obtained from Mr. Wilcox (Appendix F): • There has been no industrial use of the subject property or surrounding areas in the past. • Mr. Wilcox knows of no chemical spills on the property. To his knowledge, the only chemicals used at the facility were for housekeeping purposes and automotive maintenance. • No drums or storage tanks have been present on the property to the knowledge of Mr. Wilcox. • Mr. Wilcox suggested that oil and gas wells had been present nearby in the past but not currently. • Hazardous substances may include lead based paint, lead dust and asbestos. • The American Legion will like to use the building for commercial purposes. 6.0 FINDINGS Summarized below are the major findings from this Targeted Brownfield Assessment and DEQ’s recommendations. The major findings of the highest environmental concern are presented first. • The former Seminole Armory was built in 1953. The land for the building was deeded by the American Legion to the State of Oklahoma, on October 12, 1953, for benefit of the Oklahoma National Guard. The subject property is currently owned by the State of Oklahoma. The armory is currently owned by the State of Oklahoma and will be conveyed to the American Legion prior to cleanup activities. A Memorandum of Agreement (MOA) will be set in place between the American Legion and the DEQ. Once cleanup activities have occurred, a notice of remediation and easement will be filed in the Seminole County Courthouse. • Historic recognized environmental conditions (REC) are the old, abandoned, potentially unplugged oil wells. Phase I TBA Seminole Armory Seminole, Oklahoma 26 • The building is probably contaminated with lead dust, lead-based paint, and asbestos. The Oklahoma Department of Environmental Quality Site Cleanup Assistance Program plans to remediate any lead and asbestos contamination on the subject property and properly dispose of all associated waste. The possible lead and asbestos contamination in the building may constitute a recognized environmental condition (REC). • The property formerly contained a 1,000 gallon underground storage tank (UST) that was removed August 29, 1997. Soil samples collected below the fuel island were above the OCC action levels for TPH and ethylbenzene with 1380 mg/k and 20 mg/kg, respectively. The former UST and associated contamination constitutes a historically recognized environmental condition (HREC). • Adjoining properties consist of baseball fields and undeveloped land. Historical aerial photographs show parks surrounding the subject property. • Sanborn Fire Insurance maps showed that the subject property was vacant land before the armory was built with the presence of Magnolia Lake between 1933 and 1949. Adjacent properties consisted of undeveloped areas and a commercial sector. Sanborn maps revealed that a National Guard Armory occupied a small office space on E Broadway Street near the intersection of Main Street. This property is separate from the property being investigated in this Targeted Brownfield Assessment. • No National Priority List (NPL), delisted NPL sites, Resource Conservation and Recovery Act (RCRA) non-corrective action sites (CORRACTS) treatment, storage, and disposal (TSD) listings, Emergency Response Notification System (ERNS) list, Institutional Controls/Engineering Controls, or State landfills and/or solid waste disposal sites were found on the subject property or within the ASTM recommended search radii. No RCRA generators, Voluntary Cleanup (VCP) sites, or Brownfield sites were found on the subject property. The subject property is on the DEQ Site Cleanup Assistance Program (SCAP) list for cleanup of lead and asbestos contamination. There were seven RCRA generators listed within one mile of the subject property, and two archived Comprehensive Environmental Response, Compensation, and Liability Information System (CERCLIS) site listings. • Thirty-one underground storage tank sites were found within a ½ mile radius of the subject property. The UST sites are located east, west, southwest, and northwest of the subject property. The closest USTs to the subject property are located within one or two blocks from the subject property and are listed as permanently out of use. It is unknown if those tanks have been removed. Of the thirty-one USTs, four sites have current and historic leaking underground storage tank cases. • Oil and gas development was found in the OCC oil and gas records for the quarter, quarter, quarter sections directly above and upgradient of the site. • Pole mounted transformers, in good condition without any leaks, are located around the armory building. It is unknown if these transformers contain PCBs. Fluorescent lighting Phase I TBA Seminole Armory Seminole, Oklahoma 27 ballasts are located throughout the building. The lighting ballasts are all in good condition. It is unknown if the lighting ballasts contain PCBs. 7.0 OPINION AND RECOMMENDATIONS Due to the past use of the property and contamination found on the subject property, the environmental professionals working on this site believe that cleanup of lead and asbestos will be necessary. DEQ feels there is a low potential of impact from the LUST cases due to the distance they are located from the site. None of these LUST cases were found on the adjoining properties either. It is not believed that nearby LUST sites pose a threat, because they are listed as permanently out of use and have no associated LUST cases. The UST located in the subject property was removed according to prescribed standards by OCC on December 31, 1997. This is considered a historic REC due to the potential soil and groundwater impacts. However, based on the investigation DEQ feels there is a low potential of impact to the site from the LUST and UST sites. Two of the oil wells located near the subject property area may not be plugged, representing a safety hazard. The OCC could not find any information regarding the production or closure of these wells. In that case these wells are considered historic RECs. 8.0 DATA GAPS No tribal information was obtained for this assessment. No tax records, city directories, or zoning records were reviewed for this report. The Limited Environmental Baseline Assessment (LEBA) had not been completed by the Oklahoma Military Department at the time this TBA was conducted. However, this did not affect the ability of the DEQ to make a recommendation on the subject property. 9.0 CONCLUSIONS DEQ has performed a Phase I Environmental Site Assessment in conformance with the scope and limitations of ASTM Practice E 1527-05 of the former Seminole armory located at 600 E. Strothers Ave. Seminole, Oklahoma. Any exceptions to, or deletions from, this standard are described in Section [10.0] of this report. Recognized environmental conditions on this property include lead dust, lead-based paint, and asbestos contamination throughout the building. The information provided in this assessment is to assist the American Legion in its revitalization planning as well as meet the All Appropriate Inquiry requirement of the landowner liability protections under the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA, better known as Superfund – Ref. 2), as provided in the Small Business Relief and Brownfields Revitalization Act of 2002 (Public Law 107-118, Subtitle B – Ref. 3).
